Die Bestellung hat Folgendes zu umfassen: Produktname, Abmessungen, Ma\u00dfeinheiten, Anzahl der Produkte, gew\u00fcnschter Liefertermin sowie Ort und Versandart.<\/p><p>2.3 Eine Bestellung ist auf folgende Weise erlaubt:<\/p><p>2.3.1. Pers\u00f6nlich am Sitz des Herstellers<\/p><p>2.3.2 \u00dcber elektronische Mittel:<\/p><p>* Webseite des Herstellers sencila-medle.si,<br \/>* Web-App des Herstellers partnerji.sencila-medle.si,<br \/>* E-Mail des Herstellers info@medle.eu,<\/p><p>2.3.3 Durch physische Formen:<\/p><p>* per Post an die Adresse des Herstellers (siehe Punkt 1.2),<br \/>* per Fax (00386 7\/39-30-933),<\/p><p>2.3.4 M\u00fcndliche Bestellungen sind nicht gestattet!<\/p><p>2.4 Technische Unterlagen, Zeichnungen, Pl\u00e4ne, Fotos und relevante Beschreibungen, die dem K\u00e4ufer zum Zeitpunkt des Angebots oder zum Zweck der Bestellung zugestellt werden, bleiben Eigentum des Herstellers. Vor Best\u00e4tigung der Bestellung ist der K\u00e4ufer verpflichtet, das Angebot\/Proforma-Rechnung sorgf\u00e4ltig zu pr\u00fcfen (Daten, Skizzen pr\u00fcfen usw.) und bei Unklarheiten eine zus\u00e4tzliche Erkl\u00e4rung des Herstellers anzufordern.<br \/>Nach dem best\u00e4tigten Angebot kann der K\u00e4ufer keine Kl\u00e4rung der Unklarheit mehr verlangen und<br \/>die vereinbarten Lieferzeiten nicht mehr \u00e4ndern (Letzteres ist nicht Gegenstand von Beschwerden).<\/p><p>4.2 Die Preise der Produkte des Unternehmens werden gem\u00e4\u00df den ausgegebenen und<br \/>vom Management best\u00e4tigten g\u00fcltigen Preislisten zum Zeitpunkt der Bestellung berechnet.<\/p><p>4.3 G\u00fcltige Preislisten sind am Hauptsitz des Unternehmens erh\u00e4ltlich.<\/p><p>4.4 Alle Preise sind in Euro [EUR] angegeben. Mehrwertsteuer (nachfolgend MwSt.) ist im Preis<br \/>nicht enthalten und wird bei Rechnungsstellung berechnet.<\/p><p>4.5 Zahlungsmittel:<\/p><p>* Barzahlung beim Hersteller,<br \/>* \u00dcberweisung per Online-Bank,<br \/>* nach Zustellung.<\/p><p>4.6 Sonderangebote gelten bis zum Ausverkauf vom Lagerbestand. In den Sonderangeboten sind keine Einbaukosten enthalten, die werden anschlie\u00dfend dem Kunden in Rechnung gestellt.<\/p><p>4.7 Bei Vorauszahlung kann dem K\u00e4ufer ein Rabatt gew\u00e4hrt werden. F\u00fcr jede Bestellung vereinbaren der Hersteller und der K\u00e4ufer individuell die H\u00f6he des Rabattes, sofern dies nicht im Vertrag festgelegt ist. Dies gilt auch f\u00fcr alle anderen Rabatte.<\/p><p>4.8 Der Hersteller stellt nach der technischen \u00dcbernahme, dem Versand oder der erbrachten Dienstleistung eine Rechnung aus. Die Rechnung ist innerhalb der Frist und in der bei der Best\u00e4tigung der Bestellung vereinbarten Weise zu begleichen. Die W\u00e4hrungsperiode beginnt am Tag der technischen \u00dcbernahme, des Versands oder der erbrachten Dienstleistung.<\/p><p>4.9 Das Zahlungsdatum ist das Datum des Eintreffens der Mittel des K\u00e4ufers auf dem Konto des Verk\u00e4ufers bei seiner Gesch\u00e4ftsbank oder des Eingangs von Bargeldmitteln beim Hersteller.<\/p><p>4.10 Im Falle einer versp\u00e4teten Zahlung kann der Hersteller dem K\u00e4ufer gesetzliche Verzugszinsen und alle im Zusammenhang mit der Zahlungsforderung entstandenen Kosten berechnen (gilt f\u00fcr Klagen oder Vollstreckungen).<\/p><p>4.11 Der K\u00e4ufer, der sich mit der Zahlungen versp\u00e4tet, ist f\u00fcr alle zus\u00e4tzlichen Kosten im Zusammenhang mit der Betreibung von Schulden bei der verantwortlich, das sich mit Forderungseinzug befasst verantwortlich.<\/p><p>4.12 Ein K\u00e4ufer, der aus einem Mitgliedstaat der Europ\u00e4ischen Union stammt und eine Mehrwertsteuerbefreiung beantragt, hat dem Hersteller alle erforderlichen Unterlagen vorzulegen, die alle gesetzlichen und finanziellen (steuerlichen) Anforderungen hinsichtlich der Steuerbefreiung erf\u00fcllen. Die Lieferzeiten gelten auch f\u00fcr den Termin der erbrachten Leistung.<\/p><p>9.2 Bei unvorhersehbaren Hindernissen, die nicht nach Ermessen des Herstellers entstehen und die einen wesentlichen Einfluss auf die Erf\u00fcllung der Verpflichtungen haben, kann die Lieferzeit verh\u00e4ltnism\u00e4\u00dfig verl\u00e4ngert werden. Der Hersteller ist verpflichtet, den Kunden \u00fcber diese Hindernisse so bald wie m\u00f6glich zu benachrichtigen. Aufgrund solcher Hindernisse, die dem K\u00e4ufer mitgeteilt wurden, kann der K\u00e4ufer keinen Schadensersatzanspruch geltend machen, der durch die \u00dcberschreitung der Lieferzeit verursacht wurde. <span class=\"tlid-translation translation\" lang=\"de\"><span class=\"\" title=\"\">Unvorhersehbare Hindernisse gelten auch als alle Ereignisse, die sich direkt und indirekt auf den Betrieb des Unternehmens auswirken und f\u00fcr die das Unternehmen nicht verantwortlich ist.<\/span> <span class=\"\" title=\"\">Dies schlie\u00dft h\u00f6here Gewalt, Pandemien, Unf\u00e4lle und andere unvorhergesehene Ereignisse ein.<\/span><\/span><\/p><p>9.3 Der Montagetermin wird dem Kunden rechtzeitig mitgeteilt und wird festgelegt, so dass der K\u00e4ufer ihn ohne Zustimmung des Herstellers nicht willk\u00fcrlich verschieben kann. Zum Zeitpunkt der Montage muss der K\u00e4ufer pers\u00f6nlich anwesend sein oder durch eine autorisierte Person ersetzt werden, von der die technische \u00dcbernahme best\u00e4tigt wird. Nach Abschluss der Dienstleistung ist der Kunde zusammen mit dem Ausf\u00fchrer der Montage verpflichtet, das Objekt zu \u00fcberpr\u00fcfen und die technische \u00dcbernahme zu unterzeichnen. Falls M\u00e4ngel festgestellt werden, werden diese im Dokument vermerkt, ansonsten gilt,<br \/>dass keine M\u00e4ngel festgestellt wurden.<\/p><p>9.4 Die best\u00e4tigte Lieferzeit kann bei einer nachtr\u00e4glichen \u00c4nderung der Bestellung des Kunden verl\u00e4ngert werden.<\/p><p>9.5 F\u00fcr den Fall, dass der K\u00e4ufer das Produkt nicht innerhalb der Lieferfrist \u00fcbernahm, ist der Hersteller berechtigt, eine Rechnung auszustellen. Der Hersteller kann zus\u00e4tzliche Lagerkosten f\u00fcr hergestellte Produkte berechnen.<\/p><p>9.6 Die \u00dcbertragung der Verantwortung f\u00fcr Produkte gilt ab dem Tag der \u00dcbernahme der vom Spediteur gelieferten Produkte. Reklamationen - Haftung f\u00fcr Fehler<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ed7146 elementor-widget elementor-widget-text-editor\" data-id=\"8ed7146\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p>12.1 Der K\u00e4ufer hat eine technische \u00dcbernahme (Menge, Qualit\u00e4t usw.) durchzuf\u00fchren.<\/p><p>12.2 Die quantitative \u00dcbernahme der Waren erfolgt durch den Empf\u00e4nger in Anwesenheit des Bef\u00f6rderers oder des Herstellers, und dem Bef\u00f6rderer oder Hersteller werden etwaige quantitative Fehler in Rechnung gestellt. Durch Best\u00e4tigung des Lieferbelegs und\/oder der technischen \u00dcbernahme best\u00e4tigt der Bef\u00f6rderer oder K\u00e4ufer die quantitative \u00dcbernahme und unbesch\u00e4digte Ware zum Zeitpunkt der \u00dcbernahme.<\/p><p>12.3 Die Qualit\u00e4ts\u00fcbernahme der Ware erfolgt durch den K\u00e4ufer unmittelbar nach \u00dcbernahme des Produktes. Offensichtliche M\u00e4ngel, hat der K\u00e4ufer dem Hersteller sp\u00e4testens 8 Tage nach Erhalt der Produkte schriftlich zu melden. Der Nachweis hat in der Originalverpackung des Herstellers zu erfolgen, andernfalls wird die Beschwerde nicht erkannt.<\/p><p>12.4 Der K\u00e4ufer ist verpflichtet, dem Hersteller versteckte M\u00e4ngel unverz\u00fcglich nach Feststellung des Mangels oder innerhalb von 8 Tagen nach Feststellung des Mangels, sp\u00e4testens jedoch innerhalb von 30 Tagen ab dem Tag der Lieferung schriftlich zu melden.<\/p><p>12.5 Bei Beschwerden \u00fcber bereits beim Kunden eingebaute Produkte ist der Kunde verpflichtet, das Produkt auf Verlangen des Herstellers zur \u00dcberpr\u00fcfung und Reparatur an den Hersteller zur\u00fcckzusenden. Wenn der Kunde ein neues Produkt anfordert und die reklamierte Ware nicht zur\u00fcckgeben m\u00f6chte, ersetzt der Hersteller den (umstrittenen) reklamierten Teil des Produkts. In diesem Fall tr\u00e4gt der K\u00e4ufer die Kosten f\u00fcr andere Bestandteile.<\/p><p>12.6 Der K\u00e4ufer kann dem Hersteller die Kosten f\u00fcr die Bearbeitung der Beschwerde nicht in Rechnung stellen, wenn der Hersteller die Beschwerde gem\u00e4\u00df den gesetzlichen Bestimmungen beseitigt.<\/p><p>12.7 Im Falle einer Produktbeschwerde des K\u00e4ufers ist die R\u00fccksendung der Originalverpackung erforderlich, damit der Hersteller alle Umst\u00e4nde f\u00fcr eine professionelle Beurteilung der Situation hat.<\/p><p>12.8 Vom K\u00e4ufer gemeldete Reklamationen m\u00fcssen schriftlich beim Hersteller eingereicht werden. Der K\u00e4ufer ist verpflichtet, eine Kopie der Rechnung beizulegen und die Sch\u00e4den oder M\u00e4ngel am Produkt detailliert zu beschreiben und dem Hersteller erm\u00f6glichen, sich das beanstandete Produkt so bald wie m\u00f6glich nach der Beschwerde anzusehen.<\/p><p>12.9 Wenn der Kunde die Ausmessungen selbst vornimmt, haftet der Hersteller nicht f\u00fcr Fehler, die auf falsche Messungen zur\u00fcckzuf\u00fchren sind. Alle Kosten, die durch falsche Abmessungen des K\u00e4ufers entstehen, tr\u00e4gt ausschlie\u00dflich der K\u00e4ufer. Im Falle eines Messfehlers des Herstellers tr\u00e4gt die Kosten des Fehlers der Hersteller, der K\u00e4ufer hat dabei keinen Anspruch auf Kostenerstattung wegen versp\u00e4teter und unvollst\u00e4ndiger Ausf\u00fchrung der Arbeiten am vereinbarten Dienstleistungsort. Der Hersteller ist verpflichtet, den Mangel m\u00f6glichst bald zu beheben.<\/p><p>12.10 Der K\u00e4ufer ist verpflichtet, die Produkte bis zur Beilegung der Reklamation aufzubewahren und sie mit geb\u00fchrender Sorgfalt zu behandeln, andernfalls ist er f\u00fcr den verursachten Schaden verantwortlich.<\/p><p>12.11 Der Hersteller wird sich bem\u00fchen, die Beschwerde in \u00dcbereinstimmung mit dem Gesetz zu l\u00f6sen. Falls die Beschwerde nicht innerhalb der vereinbarten Frist gel\u00f6st werden kann, hat der Hersteller den Kunden schriftlich \u00fcber die neue Frist und die Art der Beschwerdel\u00f6sung zu benachrichtigen.<\/p><p>12.12 Der Hersteller beh\u00e4lt sich das Recht vor, die Reklamation in den auf dem Garantieschein angegebenen F\u00e4llen abzulehnen.<br \/>Die Beschwerde gilt nicht in folgenden F\u00e4llen:<\/p><p>* wenn die Beschwerde nicht innerhalb der erforderlichen Frist (8 Tage) eingereicht wird,<br \/>* wenn mit der Beschwerde keine Rechnung (Original oder Kopie) eingereicht wurde,<br \/>* wenn festgestellt wird, dass der Schaden auf unsachgem\u00e4\u00dfes oder fahrl\u00e4ssiges Verhalten des Kunden, mechanischen Schaden und Schaden bei h\u00f6herer Gewalt zur\u00fcckzuf\u00fchren ist,<br \/>* wenn das Produkt nicht zusammen mit der Originalverpackung zur\u00fcckgesandt wurde,<br \/>thermischer Bruch,<br \/>* ungeeignete Unterlage zum Anbringen von Produkten (weiche, unebene Unterlagen usw.),<br \/>* stellt das Produkt gem\u00e4\u00df genehmigten Werktoleranzen (Abmessungen, Farben, Dehnungen, Biegsamkeit usw.) her,<br \/>* nicht standardm\u00e4\u00dfige Abmessung des Produkts, wenn der K\u00e4ufer das Produkt trotz der Warnung des Herstellers vor einer m\u00f6glichen Fehlfunktion trotzdem bestellt.<\/p><p>12.13 Der Hersteller weist Beschwerden \u00fcber Oberfl\u00e4chenfehler von Profilen, die aus der Ferne nicht sichtbar sind, gem\u00e4\u00df den Qualit\u00e4tsrichtlinien \u201eGSB AL 631 \u2013 Internationale Qualit\u00e4tsrichtlinien f\u00fcr die Beschichtung von Bauteilen aus Aluminium\u201c zur\u00fcck:<\/p><p>* 3 Meter und\/oder mehr f\u00fcr Profile f\u00fcr den Au\u00dfengebrauch,<br \/>* 2 Meter und\/oder mehr f\u00fcr Profile f\u00fcr den Innengebrauch.<\/p><p>12.14 Der Hersteller weist Beschwerden \u00fcber Oberfl\u00e4chenfehler gem\u00e4\u00df den Anweisungen des Herstellers von Stoffen oder Waren zur\u00fcck.
